Terms of Sale

These terms govern your purchase of original artwork from Karen Alcantara Studio through karenalcantara.com. By placing an order you agree to these terms.

The artwork

Every painting listed on the Site is an original, one-of-a-kind work created by Karen Alcantara. Images on the Site are color-accurate representations; minor variation between your screen and the physical painting is normal and does not constitute a defect.

Orders and pricing

Prices are listed in U.S. dollars and already include shipping within the United States — there is no separate shipping charge at checkout. Any applicable sales tax is calculated at checkout. Once an order is placed and payment has been confirmed by Stripe, the piece is marked as sold and removed from the available gallery.

Because each piece is unique, we reserve the right to cancel an order in the exceptionally rare case that the same piece was sold through another channel immediately prior to your order. If that happens, the order is cancelled and your payment is released through Stripe. This is the only circumstance in which funds are returned — see our Shipping & Returns policy for full details.

All sales final

Every piece is an original. All sales are final. We do not accept returns, exchanges, or refunds once an order has been placed and payment has been received, except for the narrow non-delivery scenario described above. Please review our Shipping & Returns policy before ordering.

Payment

Payments are processed by Stripe. We do not see, store, or handle your card details. By completing checkout you authorize Stripe to charge your selected payment method for the full order total.

Shipping, delivery, and risk of loss

Shipping terms are covered in our Shipping & Returns policy. Title and risk of loss for a painting pass to you when the carrier delivers it to the shipping address you provided.

Copyright and reproduction rights

When you purchase a painting you own the physical work. Karen Alcantara retains the copyright and all reproduction rights, including the right to display images of the work for promotional purposes. You may not reproduce, print, or commercially exploit the image of the painting without written permission.

Limitation of liability

To the fullest extent permitted by law, Karen Alcantara Studio’s total liability for any claim arising out of a purchase is limited to the amount you paid for the relevant painting. We are not liable for indirect, incidental, or consequential damages.

Changes to these terms

We may update these terms from time to time. The version in effect at the time of your order is the version that applies to your purchase.

Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles.
